主权又称国家主权，指的是一个国家独立自立处理自己内外事务，管理自己国家的最高权力。主权是国家区别于其他社会集团的特殊属性，是国家的固有权利。这表现为：1，对内最高权，即国家对它领土内的一切人（享有外交豁免权的人除外）和事物以及领土外的本国人实行管辖的权力，有权按照自己的情况确定自己的政治制度和社会经济制度；2，对外独立权，即国家完全自主地行使权力，排除任何外来干涉；3，自卫权，即国家为维护政治独立和领土完整而对外来侵略和威胁进行防卫的权力。主权是国家作为国际法主体所必备的条件，互相尊重国家主权是现代国际法确认的一条基本原则。丧失主权，就会沦为其他国家的殖民地和附属国。主权和领土有着密切的联系，国家根据主权对属于它的全部领土行使管辖权，反过来，主权也必须有领土才能存在和行使。

现代意义上的主权概念最早起源于希腊，主权（Sovereignty）这样一个英文词是来源于拉丁文superanus，意味着一个最高权力。国家主权又称主权，指的是一个国家独立自主处理自己内外事务，管理自己国家的最高权力。主权是国家区别于其他社会集团的特殊属性，是国家的固有权利。全体国民及其生活的地域一起形成国家，国家主权的根源存在于全体国民。所以国家主权的目的是保护国家的完整性，保护全体国民的利益。任何团体或个人都不得行使非直接来自于国民授予的权力，更不可利用国家主权进行其他目的的交易。

该理论起源于16世纪 法国思想家J.博丹创立的主权理论。 他认为主权是一国享有的、 统一而不可分割的、凌驾于法律之上的最高权力。荷兰法学家H.格劳秀斯进一步指出：主权即权力的行使不受另外一种权力的限制，当一国不受任何别国控制而处理内部事务时就表现为主权。主权观念为国际关系和国际法奠定了理论基石。主权原则成为国际关系的根本准则。

该理论的要点是：①主权是国家固有的属性，具有不可转让、不可分割和不可侵犯的神圣地位，具有排他性；②主权是国家独立自主地处理内外事务的最高权力；③主权具有两重性：在国内有最高的对内主权，在国际上有独立的对外主权，二者是统一而不可分割的；④主权的内容包括领土完整、政治独立、经济自主和与别国的主权平等；⑤主权国家是国际法的主体，也是国际关系唯一的行为主体。该理论认为在国际社会中拥有主权的国家应有权独立自主地处理本国内外事务，决定内外政策，采取它认为合适的和必要的措施来保护自身的利益并实现既定的目标。
