Nellie McClung 1873-1951She was one of the most important leaders of Canada's first wave of feminism, and she is still remembered for her role in the famous "Person's Case" which saw Canadian women declared persons in 1929.Nellie Letitia Mooney was born in Ontario in 1873, and moved to Manitoba when she was seven years old. Nellie, a lively, talkative little girl, began teaching school in rural Manitoba when she was just 16 years old. As a young woman she became involved in social reform and joined the Women's Christian Temperance Union(WCTU), which was especially concerned with the social and health problems caused by alcohol. The group fought many other social problems facing women and children, and spearheaded the campaign for women's right to vote in many parts of the country.In 1896 Nellie married Robert Wesley McClung, the son of one of Nellie's friends in the WCTU. The couple eventually had five children and in 1911 the family moved to Winnipeg where Nellie McClung continued her career as a social reformer. The suffrage movement was in its heyday during her years in Winnipeg. McClung continued to be active in the WCTU, but she also joined the Winnipeg Political Equality League, a group committed to helping the female wage earners of the city, and the Canadian Women's Press Club. She led Manitoba Premier Rodmond Roblin through the city's sweatshops to demonstrate the appalling working conditions many women faced. When Roblin suggested "nice" women did not want the vote, Nellie McClung retorted: "By nice women...you probably mean selfish women who have no more thought for the underprivileged, overworked women than a pussycat in a sunny window for the starving kitten in the street. Now in that sense I am not a nice woman for I do care."Premier Roblin strongly opposed giving women the right to vote, and in 1914 Nellie McClung and her fellow reformers wanted to defeat him. They put on a play called "The Women's Parliament," a satire which turned the tables and poked fun at the dangers of giving men the right to vote. Nellie McClung's parody of premier Roblin's arguments caused uproarious laughter for packed and enthusiastic audiences. Although Roblin's Conservative government was re-elected, his victory was short-lived. The next year the suffragists helped to defeat him and in 1916 the new Liberal government gave the vote to Manitoba women. Women in Alberta, Saskatchewan, and British Columbia gained the right to vote in provincial elections the same year, and the other provinces soon followed. (However, it is important to note that women of Asian and First Nations descent were denied the right to vote until after World War II.) A major victory had been won. Newspapers and politicians gave Nellie McClung much of the credit.In 1914 the McClungs moved again, this time to Edmonton, Alberta, where Nellie McClung continued her political literary career. She joined the Edmonton Equal Franchise League which fought for women's rights, prohibition and factory safety legislation. In 1921 she was elected as a Liberal member of the Legislative Assembly of Alberta where she fought for mother's allowances, public health nursing, free medical and dental care for children, liberalised birth control, divorce laws, and improved property rights for married women. Her career as an elected politician was brief. She was defeated in 1925 after serving only one term. In 1927 she joined Emily Murphy, Irene Parlby, Louise McKinney, and Henrietta Edwards for what would become known as "The Person's Case." What was at issue was whether women could be appointed to the Canadian Senate. Canada's constitution, then the British North America Act, stated that one must be a "person" to serve in the Senate, but in 1928 the Supreme Court of Canada ruled that when the BNA Act was written in 1867, the term "person" was not meant to include women, but only men. The women appealed the decision to the Judicial Committee of the British Privy Council, then the highest court for Canadian constitutional interpretation. In October 1929 the Judicial Committee ruled that Canadian women were, in fact, persons and could be appointed to the Senate.Through the 1930s McClung's writing career flourished with the publishing of newspaper articles, short stories, another novel, and her memoirs. Supporter of women's right to be ministers in the United Church of Canada, delegate to the League of Nations, and the first women appointed to the CBC's Board of Governors were added to the continuing list of her accomplishments. Through the Canadian Authors' Association and Canadian Women's Press Club she was also a strong promoter of cultural nationalism. Though she died in Victoria in 1951, she has continued to live in the spirit of Canadian women's ongoing struggle to achieve social, economic and political equality.
