判例一词，通常在两种含义上使用：判例和判例法。在英文中有Case和Precedent两个词。Case作判例讲时主要指对整个案情的叙述和报告，侧重于法官对法律问题的阐述;Precedent作判例时主要指先例，是在法律渊源的意义上对以后相同或类似案件具有约束力的判决。 布莱克法律词典这样解释：“一项已经判决的案件或法院的判决，它被认为是为一个后来发生的相同或类似的案件，或者相似的法律问题，提供了一个范例或权威性的法律依据。法院试图按照在先前的案件中确立的原则进行审判。这些事实或者法律原则方面与已在审理的案件相近似的案件称为先例。法院首次为一个特殊类型的案件所确立的，并且后来在处理相似的案件时供参考的法律原则”。 先例的识别、适用规则、判例等的汇编、出版、援引制度，以及相关的法院审级、管辖制度等构成先例制度(PrecedentSystem)，也称为判例制度(CaseSystem)。
