最惠国待遇zuìhuìguó dàiyù[most-favored-nation treatment] 国与国之间根据某些条约规定的条文,在进出口贸易、税收、通航等方面互相给予优惠利益、提供必要的方便、享受某些特权等最惠国待遇 ，Most Favoured Nation 英文简称MFN,是国际经济贸易关系中常用的一项制度，又称“无歧视待遇”。它通常指的是缔约国双方在通商、航海、关税、公民法律地位等 方面相互给予的不低于现时或将来给予任何第三国的优惠、特权或豁免待遇。条约中规定这种待遇的条文称“最惠国条款”。路透金融词典的解释最惠国待遇是指双边贸易协定中的一项承诺,规定缔约国的一方若给与第三国某种优惠待遇,缔约国的另一方即时获得相同的优惠待遇.最惠国待遇可分为无条件最惠国待遇和有条件最惠国待遇两种。前者指缔约国的一方现在或将来给予第三国的一切优惠，应无条件地、无补偿地、自动地适用于缔约国的另一方。后者指缔约国的一方现在或将来给予 第三国的优惠，缔约国的另一方必须提供同样的补偿，才能享受。 最惠国待遇范围广泛，其中主要的是进出口商品的关税待遇。在贸易协定中一般包括以下内容：1、有关进口、出口或者过境商品的关税和其他捐税2、在商品进口、出口、过境、存仓和换船方面的有关海关规定 、手续和费用；3、进出口许可证的发给。在通商航海条约中，最惠国待 遇条款适用的范围还要大些，把缔约国一方的船舶和船上货物驶入、驶出 和停泊时的各种税收、费用和手续等也包括在内。在特殊条件下，最惠国待遇源于自由贸易原则，即各国在世界市场上享有平等的、不受歧视的贸 易机会。是用来作为对付重商主义保护关税政策的一种手段。到自由资本 主义时期，为各资本主义国家普遍采用。后来帝国主义国家往往利用他们签订的最惠国条款，在殖民地、附属国中享受各种特殊优惠，而后者则由 于所处的从属地位，实际上难以享受到相应的优惠。二次大战后，许多发 展中国家为了改变这种不合理状况，要求发达国家对所有发展中国家的出 口商品实行单方面的、普遍的关税减免，即实行关税普遍优惠制。最惠国待遇原则也有可以不执行的例外情况：第一，某发达国家给予发展中国家出口的工业品及半成品以更加优惠的差别的关税待遇；在非关税措施方面给予发展中国家更为优惠的差别的待遇；发展中国家之间实行的优惠关税；对最不发达国家的特殊优惠；可不给予其他发达国家成员。第二，自由贸易区、关税同盟及边境贸易所规定的少数国家享受的待遇和经济一体化组织内部的待遇，可不给予其他世贸组织成员。第三，一些成员为保障动、植物及人民的生命、健康、安全或一些特定目的对进出口采取的所有措施，不受最惠国待遇的约束。第四，当一国的国家安全受到威胁时，可以不受最惠国待遇的约束。第五，反补贴、反倾销及在争端解决机制下授权采取的报复措施，不受最惠国待遇的约束。第六，货物贸易中的政府采购不受世贸组织管辖，所以不受最惠国待遇的约束。第七，不属世贸组织管辖范围的诸边贸易协议中的义务。主要指在民用航空器贸易、奶制品及牛肉贸易等方面，世贸组织成员彼此间可以不给予最惠国待遇。在服务贸易中，根据最惠国待遇原则，WTO规定在服务和服务的提供者方面， 各成员应该立即和无条件地给予任何其他成员的服务及服务提供者相同的待遇。但鉴于服务贸易发展的水平参差不齐， WTO 《服务贸易总协定》允许少数成员在2005年以前，存在与最惠国待遇不符的暂时性措施。在2005年之后，最惠国待遇原则上应是无条件的、永久的在所有成员间实施。在与贸易有关的知识产权方面，最惠国待遇原则要求除有关国际条约规定的外，某一成员提供给其他成员国民的任何利益、优惠、特权或豁免，均应立即无条件地给予全体世贸组织其他成员的国民
