诽谤： 说人坏话，诋毁和破坏他人名誉。诽是背地议论，谤是公开指责。

污蔑：歪曲事实，造谣毁谤，败坏人家的名誉。主要有玷污，使某物不再纯洁的意思，而污蔑主要是用话语栽赃陷害的意思。

诽谤，在刑法上有个自诉罪名“侮辱诽谤罪”，但是严重危害社会秩序和国家利益的除外。简单的说，严重的诽谤是可以入罪的。污蔑则没有罪名对应。但是，从民法的角度，两种行为都可以构成侵权。
