合同形式，是指当事人合意的外在表现形式，是合同内容的载体。我国《合同法》第10条：当事人订立合同，有书面形式，口头形式和其他形式。法律，行政法规规定采用书面形式的，应该采用书面形式。当事人约定采用书面形式的，应当采用书面形式。
经济合同的形式是指经济合同当事人之间明确权利义务的表达方式，也是当事人双方意思表示的表现方法。根据经济合同法规定，经济合同的形式主要有口头形式和书面形式两种。
口头形式
